Former Nina’s Custard site sold, coffee shop planned
An affiliate of Bevilacqua Development has officially purchased the former Nina’s Frozen Custard property at 2577 Millersport Highway, Amherst, with plans to turn the building into a coffee shop.
2577 Millersport LLC, the Bevilacqua affiliate, and GS 0 Cemetery LLC, led by Kulback’s Construction CEO David Kulbacki, paid $910,000 for the building, according to Erie County property records.
The sellers were Anthony Scioli III and Susan Lettieri.
The Scioli and Lettieri families owned Nina’s and made the decision to close the longtime custard shop at the end of last year.
Bevilacqua plans to build a “quick-service coffee restaurant” with a drive-thru on the site. The developer has not named a specific occupant.
The project was the subject of a brief lawsuit between the developer and the town. The project needed several variances to allow the drive-thru. Town officials ruled that the project would require use variances rather than easier-to-obtain area variances. Bevilacqua sued the town in April, arguing that decision was improper.
The two sides settled out of court in May, according to court records.
In June, the town planning board approved rezoning the site from the neighborhood business district to the general business district, which is more permissive regarding drive-thrus.
In its application for rezoning, Bevilacqua argued that a drive-thru was necessary for a restaurant on the site to be competitive, and pointed out that a Burger King restaurant less than 500 feet away already has a drive-thru.
A timeline for construction has not been set.
